A surface rights holder is an individual who owns rights to land which do not include the mineral rights. Section 46.1 of the Mining Act requires that the prospector notify the surface rights owner 60 days after making the application to record a mining claim. This database tracks surface rights notification requirement for all claims staked in Ontario. This database identifies which claims require surface rights notification and how many owners require notification.
